Most women enter Dubai under the sponsorship of their husbands. A husband can sponsor his wife if he has a minimum salary of AED4000, OR AED 3000 if accommodation is provided. After reaching and settling down, some women decide to start /resume their careers. Unlike in India, there are some legal formalities to be completed. Women who want to start working for a company need to obtain a work permit /labour card from the company. In addition to this, she has to obtain a No Objection Certificate from her husband, who is currently her sponsor.
Legally said, A No Objection Certificate (NOC) is a formal letter by your current sponsor addressed to the Department of Labour and the Department of Naturalisation and Immigration to prevent, the employee, from being banned after completion of the labour contract or in the process of transferring sponsorship to a new employer.
The NOC would denote that the husband has no objection whatsoever to his wife working for another company. It is illegal to start work without a work permit and NOC. If the above conditions are not satisfied, she can have a labour ban placed or even be deported. So to be on the safer side always, it is better to comply with the legal formalities and get the work permit and NOC ready before beginning work.
Though employed, women can continue on their husbands ??residency sponsorship as they get more benefits this way. For example, it enables having a family status allowances for flights, accommodation, school fees and medical coverage. If they want to change jobs also, this can be done by canceling or transferring the labour card, while continuing on the residency sponsorship. In this case, the NOC should be obtained from the current employer for official purposes by the future employer.
In the case of girls who are supported on their fathers?? residency visa, they would have to obtain the NOC from their father stating that he has no objection to his daughter undertaking employment at the company.
The NOC must be given freely by the sponsor, be it the father, husband or current employer. There is no legal obligation for a sponsor to do so. Also the sponsor cannot be forced to provide the NOC.
